Terms of Service

1. Acceptance of Terms

By accessing, registering for, or using QoreQR (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and QoreQR ("we," "us," or "our").

2. Description of Service

QoreQR is a SaaS platform that enables users to:

  • Generate static and dynamic QR codes
  • Manage QR codes via a personal dashboard
  • Access analytics on QR code scans (including geographic and device data)
  • Create QR codes in bulk
  • Integrate with third-party services via API or native connectors

We reserve the right to modify, suspend, or discontinue any feature of the Platform at any time, with or without notice.

3. Account Registration and Security

3.1 Eligibility

You must be at least 13 years old to use the Platform. By registering, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3.2 Account Credentials

You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your login credentials
  • Notify us immediately of any unauthorized use of your account

You are solely responsible for all activities that occur under your account.

4. Subscription Plans and Payments

4.1 Plan Tiers

The Platform offers three subscription tiers:

  • Free Plan: Limited features, available upon registration
  • Professional Plan: Enhanced features, billed monthly
  • Business Plan: Advanced features and priority support, billed monthly

4.2 Billing and Payments

  • Payments for paid plans are processed securely through third-party payment processors. We do not store or handle your payment card information.
  • Subscriptions automatically renew at the end of each billing cycle unless canceled prior to renewal.
  • You may cancel your subscription at any time via your account dashboard. Cancellation takes effect at the end of the current billing period; no partial refunds are provided for mid-cycle cancellations.

4.3 Refund Policy

Requests for refunds are considered on a case-by-case basis. For assistance, please contact our support team via the feedback form, marking your enquiry as "refund". We reserve the right to determine the validity of a refund in accordance with applicable legislation.

4.4 Price Changes

We reserve the right to modify subscription pricing with reasonable notice. Price changes will not affect active subscriptions until the next renewal cycle.

5. Acceptable Use and Prohibited Activities

5.1 Permitted Use

You may use the Platform to generate QR codes for lawful personal or business purposes, subject to these Terms.

5.2 Prohibited Activities

You agree not to use the Platform to:

  • Generate QR codes that link to phishing sites, malware, or fraudulent content
  • Distribute spam, unsolicited communications, or deceptive marketing materials
  • Violate any applicable law, regulation, or third-party rights (including intellectual property, privacy, or publicity rights)
  • Attempt to reverse engineer, scrape, or exploit the Platform's infrastructure
  • Use the Platform to harass, defame, or harm others
  • Create QR codes intended to bypass security systems or gain unauthorized access

Violation of this section may result in immediate termination of your account and legal action.

6. Intellectual Property Rights

6.1 Our Rights

The Platform, including its software, design, logos, and content, is owned by QoreQR and protected by copyright, trademark, and other intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purpose.

6.2 Your Content

You retain all rights to the content you link to via QR codes ("User Content"). By using the Platform, you grant us a worldwide, royalty-free license to store, process, and display your QR codes and associated analytics solely to provide and improve the service.

6.3 QR Code Ownership

QR codes generated through the Platform are your property. However, dynamic QR codes rely on our infrastructure to function; termination of your account may render such codes inactive.

7. Analytics and Data Usage

7.1 Scan Analytics

For QR codes with analytics enabled, we collect aggregated, non-personal data about scans (country, city, time, device type). We do not collect or store IP addresses or personally identifiable information from end-users who scan QR codes.

7.2 Reporting

Analytics data is made available to account holders via the dashboard. You agree not to use this data to attempt re-identification of individuals or for any unlawful purpose.

8. Third-Party Services and Integrations

The Platform may integrate with third-party services (e.g., payment processors, email providers, APIs). Your use of such services is subject to their respective terms and privacy policies. We are not responsible for the practices, content, or security of third-party services.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
  • ANALYTICS DATA WILL BE COMPLETELY ACCURATE OR REAL-TIME
  • QR CODES WILL FUNCTION INDEFINITELY OR COMPATIBLY WITH ALL DEVICES

YOU USE THE PLATFORM AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL QoreQR, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to defend, indemnify, and hold harmless QoreQR and its affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any third-party right, including intellectual property or privacy rights
  • QR codes you generate that cause harm or legal liability

12. Termination

12.1 By You

You may terminate your account at any time via the "Delete Account" function in your dashboard. Upon deletion:

  • All personal data and QR codes associated with your account are permanently removed
  • Dynamic QR codes generated under your account will cease to function

12.2 By Us

We reserve the right to suspend or terminate your access to the Platform immediately, without notice, if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Pose a security risk to the Platform or other users

12.3 Effect of Termination

Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, and governing law) shall remain in effect.

13. Data Portability and Export

You may export your QR code data and analytics in a structured, commonly used format via your account dashboard. We support data portability in accordance with applicable privacy laws.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or a prominent notice on the Platform. Your continued use of the Platform after such changes constitutes acceptance of the updated Terms.

15. General Provisions

  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
  • Waiver: Our failure to enforce any right or provision will not be deemed a waiver.
  • Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and QoreQR regarding the Platform.
